These Terms & Conditions (“Terms”) govern your access to and use of Paykar India services through the website, mobile applications, or via authorized agents. The services (“Services”) include AEPS, DMT, mobile/DTH recharge, bill payment, micro ATM, PAN card processing, and related digital financial offerings.

By accessing or using any part of the platform, you agree to be legally bound by these Terms. If you disagree with any part, you should discontinue use immediately.


1. Definitions & Interpretation

  • User: any individual or entity accessing or using Paykar India services.

  • Service Provider/Agent/Distributor: authorized person or entity facilitating transactions.

  • KYC: Know-Your-Customer documentation as required by RBI/UIDAI guidelines.

  • Platform: Paykar India digital interface (website, app, APIs).

  • Content: explanation of services, user data, and transactional records.

  • Applicable Laws: includes the Information Technology Act 2000, Aadhaar Act 2016, NPCI/UPI/RBI circulars, DPDP Act, etc.


2. Eligibility and User Rights

  • Only individuals aged 18 or older, residing in India, and not prohibited under Indian law, may use the Services.

  • Users must maintain accurate and complete information. If inaccuracies emerge, Paykar reserves the right to suspend or terminate access.

  • Acceptance through registration, login, or usage means you acknowledge and consent to all Terms.


3. Service Description and Access

Paykar India provides the following services, subject to terms, availability, and KYC validation:

  • AEPS (Aadhaar Enabled Payment System): balance enquiry, cash withdrawal, mini-statement using biometric authentication.

  • Domestic Money Transfer (DMT): via IMPS/NEFT/UPI to eligible bank accounts.

  • Recharge Services: prepaid & postpaid mobile and DTH recharges.

  • Bill Payments (BBPS): utility bills like electricity, water, gas, broadband, insurance premiums.

  • Micro ATM: cash withdrawal through debit cards at merchant points.

  • PAN Services: new PAN or corrections through authorized NSDL/UTI portal.

  • Travel Booking (if available): bus and flight ticket bookings.

Access to the services requires successful KYC completion. Service availability varies by change in third-party partner APIs or regulatory norms.


4. Registration, Account Maintenance, and Security

  • Users must register through our platform using valid mobile number, identity documents, and other KYC requirements.

  • You are responsible for keeping your login credentials secure. Unauthorized usage may lead to termination or suspension.

  • You agree to notify us immediately of any unauthorized use or security breach.


5. KYC Requirements and Verification

  • Paykar conducts KYC per UIDAI and RBI mandates—this may include Aadhaar authentication via biometric/PIN or OTP and submission of PAN, address, or utility documents.

  • Consent for Aadhaar authentication is mandatory and recorded.

  • Any failure in the validation process slows or denies access to certain services.

  • KYC data is stored securely per IT and Aadhaar Act guidelines, and deleted when no longer required by regulations.


6. Pricing, Commissions, and Charges

  • Paykar may charge service fees, convenience charges, and/or offer commissions to agents as disclosed prior to each transaction.

  • All applicable GST or taxes will be levied and mentioned during checkout.

  • Service charges and commission structures may be changed from time to time; users will be notified at least 7 days before any modification.


7. Transactions, Refund, and Cancellation Policy

  • Transactions once processed successfully are generally non-refundable.

  • Failed transactions (e.g., debit but no service delivered) are usually refunded automatically in 24–72 working hours depending on partner systems.

  • For travel or PAN-related services, cancellation will follow third-party service provider policies, including deductions.

  • Refunds are credited to the original payment source or user wallet.

  • Disputes can be raised through the grievance/helpdesk feature, within 7 working days from the date of the transaction.


8. Liability & Disclaimers

  • Paykar, its officers, employees, affiliates, and agents will not be liable for any indirect, incidental, or consequential loss, including loss of profit, arising from use of Services.

  • We do not guarantee uninterrupted or error-free access; temporary downtime due to third-party API failure, network outages, or maintenance may occur.

  • We are not responsible for mistakes arising from user errors (e.g. wrong account number or Aadhaar).

  • Fraud or misuse due to negligence by user is not the liability of Paykar.

  • In all cases, Paykar’s liability is capped at the amount of the transaction in dispute.


9. Data Protection and Confidentiality

  • All personal and financial data is governed by our Privacy Policy, which is compliant with the IT Act 2000, Aadhaar Act, UIDAI guidelines, NPCI frameworks, PDP Act, and RBI directives.

  • We use encryption (AES‑256, TLS1.2+) for data in transit and at rest.

  • User biometric data is never stored beyond secure encrypted PID blocks.

  • Personal data is not shared without consent except as required by applicable law or regulatory authority.


10. Fraud Monitoring and Compliance

  • Paykar reserves the right to monitor transactions for suspicious activity in compliance with AML/KYC guidelines.

  • If suspicious or unusual behavior is detected, the account may be suspended or terminated.

  • We will comply with all government, law-enforcement, and regulatory authorities upon lawful request.


11. Termination & Suspension of Accounts

  • Accounts may be suspended or terminated if:

    • KYC documents are false or forged

    • Services are used for illegal or fraudulent activity

    • Terms & Conditions are violated

    • A regulatory or court order mandates it

  • You may close your account by raising a request via email. Certain onboarding or transaction records may remain retained for regulatory compliance after account termination.


12. Intellectual Property Rights

  • All content, logos, trademarks, software, dashboards, and technology associated with Paykar India are owned by Ingeven Payment Private Limited.

  • You may not reproduce, modify, sublicense, or redistribute any part of the intellectual property without prior written consent.

  • User‑generated content (e.g., reviews, feedback) can be used by Paykar with attribution or anonymously.


13. Modifications to Terms

  • These Terms may be revised periodically to reflect regulatory changes, service enhancements, or business decisions.

  • Substantial changes will be communicated via email, in-app notification, or website banner at least 7 days prior to implementation.

  • Continued usage after changes implies acceptance of the updated Terms.


14. Notifications & Communications

  • Key communications—such as policy changes, security alerts, transaction notifications—will be delivered via SMS, email, or in-app messages.

  • Promotional communications only with your prior consent.

  • You may opt-out of marketing messages anytime through settings or by emailing privacy@paykarindia.com.

We commit to acknowledging all grievances within 2 working days and resolving them within 21 working days. If unsatisfied, users can escalate under Section 33B of the Aadhaar Act 2016 or approach relevant legal forums.


16. Governing Law & Jurisdiction

  • These Terms are governed by the laws of the Republic of India (Information Technology Act 2000, Payment Systems Act, Aadhaar Act, DPDP Act, etc.).

  • Disputes arising hereunder shall be subject to the exclusive jurisdiction of courts located in Patna, Bihar, India.


17. Severability

  • If any provision of these Terms is held invalid or unenforceable under applicable law, the remaining provisions shall continue in effect.

  • Invalid clauses shall be interpreted to best accomplish the intended purpose.


18. Whole Agreement

These Terms together with the Privacy Policy and Refund Policy constitute the entire agreement between you and Paykar India regarding the provision of Services. Any prior agreements or communications are superseded.

20. Indemnification

You agree to indemnify, defend, and hold harmless Paykar India, its parent company Ingeven Payment Private Limited, its affiliates, licensors, partners, employees, agents, and service providers from and against any and all claims, losses, expenses, liabilities, damages, costs, and demands (including reasonable legal fees) arising out of or relating to your:

  • Violation of these Terms & Conditions;

  • Breach of any applicable law, rule, or regulation;

  • Misuse or fraudulent use of any service;

  • Infringement of any third party’s rights including intellectual property or privacy;

  • Any content you upload, submit, post, or transmit through our platforms.

Paykar reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with us.

21. Force Majeure

Paykar India shall not be held liable for any failure or delay in performance due to acts of nature, war, terrorism, epidemics, pandemics, labor disputes, civil disturbances, internet outages, power failures, governmental actions, or any other cause beyond its reasonable control.

Force majeure shall not excuse payment obligations or any KYC/UIDAI compliance responsibilities that are regulatory-mandated.

22. Prohibited Uses

You agree not to use the platform for:

  • Uploading or transmitting viruses, malware, or other malicious code;

  • Conducting fraudulent transactions or money laundering;

  • Violating any applicable financial laws, RBI, NPCI, or UIDAI rules;

  • Attempting unauthorized access to other systems, accounts, or networks;

  • Reselling or providing the services to third parties without express authorization from Paykar India.

Violation of this clause may result in immediate suspension or termination of services and may attract legal action under the Information Technology Act, 2000.

23. Advertising and Promotion

Paykar India may offer advertising opportunities or promotional campaigns on its digital properties. These promotions may involve Paykar India or authorized third-party partners.

Users acknowledge that any interaction with third-party advertisers is solely between the user and the respective advertiser. Paykar shall not be responsible for any loss or damage incurred as a result of such interactions.

We may use cookies, tracking pixels, or other technologies to tailor advertising content. Users may opt out of certain tracking features via browser settings or through formal opt-out mechanisms.

24. Communication and Consent

By registering on Paykar India’s platform, users agree to receive communications including, but not limited to:

  • Transactional SMS and emails;

  • OTPs and alerts for account security;

  • Promotional offers, updates, and newsletters;

  • Service disruption notices.

These communications are essential for providing uninterrupted services. Users may opt out of promotional communications, but transactional and security messages are mandatory and cannot be disabled.

For services involving Aadhaar, biometric authentication, or e-KYC, explicit consent will be digitally recorded. This consent includes:

  • Authorization to use Aadhaar for authentication;

  • Permission to fetch KYC data from UIDAI;

  • Storage and use of minimal necessary data as permitted under the Aadhaar Act.

25. Audit and Inspection

In accordance with RBI, UIDAI, NPCI, and other regulatory authorities, Paykar India is obligated to maintain logs, audit trails, and transaction records.

We may conduct internal or external audits to:

  • Ensure compliance with AML (Anti-Money Laundering) and KYC regulations;

  • Investigate user-reported complaints or discrepancies;

  • Validate service uptime, downtime, and resolution reports.

Users may be contacted or asked to furnish additional documentation in the event of an audit. Refusal or failure to cooperate may lead to temporary suspension of service until the issue is resolved.

26. Agent & Distributor Code of Conduct

All appointed agents, distributors, and channel partners of Paykar India must comply with the following code of conduct:

  • Always verify customer identity using valid KYC documents;

  • Do not charge unauthorized commissions or fees from customers;

  • Maintain transparency in all transactions;

  • Educate customers about the service terms, limitations, and risks;

  • Protect user data and never misuse Aadhaar or biometric information;

  • Cooperate fully with Paykar India in audits or compliance reviews;

  • Maintain transaction records and receipts accurately;

  • Ensure all devices used (Micro ATMs, biometric scanners) are certified and operational.

Strict Disciplinary Action:
Violations may lead to immediate suspension of services, legal proceedings, monetary penalties, and reporting to appropriate authorities (NPCI, UIDAI, RBI). Repeat violations may result in permanent blacklisting.

27. Intellectual Property Rights

All content, graphics, user interfaces, photographs, trademarks, logos, and software code on the Paykar India platform are the intellectual property of Ingeven Payment Private Limited or its licensors.

Unauthorized copying, modifying, distributing, displaying, or using any such material without written consent is strictly prohibited.

Any third-party trademarks or logos are the property of their respective owners and are used only to denote compatibility or integration.

28. Legal Disclosures and Compliance

Paykar India complies with all applicable Indian laws and regulations including:

  • The Information Technology Act, 2000;

  • The Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016;

  • RBI Guidelines on Digital Payment Services;

  • NPCI Operational and Technical Guidelines;

  • Prevention of Money Laundering Act (PMLA), 2002.

We also reserve the right to introduce new compliance frameworks as advised by regulators from time to time. Users are expected to stay updated by checking our Terms and Conditions regularly.

29. Termination of Services

Paykar India reserves the right to suspend or terminate any user’s access to the platform and services without prior notice under the following conditions:

  • Non-compliance with these Terms & Conditions;

  • Fraudulent, illegal, or suspicious activity;

  • Providing false or misleading information during KYC;

  • Violations of RBI or NPCI guidelines;

  • Requests by legal authorities, law enforcement, or court orders;

  • Breach of contractual obligations as an agent or distributor;

  • Continuous misuse of the platform for purposes outside its defined scope.

Upon termination:

  • Access to the wallet and related services will be restricted;

  • Refund of unused wallet balances will be made to verified bank accounts subject to KYC validation;

  • Account data will be retained in accordance with RBI, UIDAI, and PMLA obligations for audit and regulatory purposes.

30. Force Majeure

Paykar India shall not be held liable for any delay or failure in the performance of its services due to circumstances beyond its reasonable control, including but not limited to:

  • Acts of God, fire, explosion, flood, earthquake, storm, or other natural calamities;

  • War, terrorism, riots, civil unrest, government actions, strikes, or embargoes;

  • Internet failures, power outages, hardware/software malfunctions;

  • Failures by third-party service providers, including banking networks or telecom operators.

In such cases, Paykar India will attempt to restore services promptly but shall not be liable for any direct, indirect, incidental, or consequential damages arising due to non-availability during such periods.

31. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of India.

Any disputes or claims arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the competent courts located in Patna, Bihar, India.

If any part of this agreement is held to be invalid or unenforceable by law, the remaining parts shall continue to be valid and binding.

32. Grievance Redressal

As per IT Act and RBI mandate, Paykar India appoints a Grievance Redressal Officer. Users may raise concerns or complaints related to:

  • Payment failure or delays;

  • KYC-related issues;

  • Platform malfunctions;

  • Data security or privacy breaches;

  • Agent or distributor misconduct.

34. Updates and Modifications

Paykar India may modify, amend, or revise these Terms & Conditions at any time, with or without notice. Changes will be effective from the date of publication on the website.

Users are encouraged to review the Terms periodically. Continued use of the platform after such updates constitutes acceptance of the revised agreement.

35. Entire Agreement

This document, along with our Privacy Policy, Cancellation Policy, and specific service agreements, represents the entire agreement between the user and Paykar India regarding the use of our platform.

No oral advice or written information outside of these published documents shall be considered legally binding unless authorized by the Board of Ingeven Payment Private Limited.
